Determination of "Occupied Territory" status by authoritative organization/agency

I work with several small human rights groups in Taiwan. "Taiwan" is not regarded as a sovereign state in the international community, but why? This is confusing. After some research, my associates and I strongly believe that the current legal status of Taiwan is that it is "territory under military occupation." This military occupation has continued from Oct. 25, 1945 (the surrender date of Japanese troops in Taipei) to the present. It appears to be a proxy occupation, which is basically a "principal - agent relationship." The "United States of America" is the principal. The "Republic of China" (originally led by Chiang Kai-shek) is the agent. Some brief summaries of our research are online at -- [login to view URL] The definition of military occupation was conclusively established in the Hague Regulations: "Territory is considered occupied when it is actually placed under the authority of the hostile army. The occupation extends only to the territory where such authority has been established and can be exercised.” The US has effective control over Taiwan by proxy. Nevertheless, I will be honest and say that this "military occupation" line of reasoning and analysis is very unfamiliar to most human rights activists in Taiwan. Military occupation falls in the realm of "laws of war" studies, which is also called "international humanitarian law" (IHL). Some educational institutions have courses in this subject, but many do not. At the same time, many lawyers are unfortunately unfamiliar with this particular branch of law. We want to determine the proper means and procedure for authoritatively documenting the status of Taiwan as territory under military occupation in the present era. We need to have a determination that will help us deal with any international courts, government agencies, think-tanks, or other organizations. In particular, we are wondering if it is possible to obtain an official determination from the International Committee of the Red Cross in Geneva, Switzerland to the effect that Taiwan is territory under military occupation? What is the application procedure? What are the costs involved? (In general, the ICRC is regarded as "overseeing" the development of IHL.) If Taiwan is occupied territory, then the mass naturalization of the local populace by Chiang Kai-shek's military officers in Jan. 1946 was illegal, that the confiscation of all Japanese property in Taiwan beginning in 1946 was illegal, that the issuance of "Republic of China" identification documents to native Taiwanese people is without legal basis, that military conscription by the "Republic of China" regime in occupied Taiwan in the current era is illegal, etc. All of these facts would flow directly from a determination that the United States is conducting a proxy occupation of Taiwan. With the determination (or "ruling") that Taiwan's legal status is truly "occupied territory," we believe that all human rights groups in Taiwan would be able to pursue their human rights agendas in the international community much more effectively. Again I stress that we do not have access to the International Court of Justice since Taiwan only regarded as a are groups of individuals living in the non-UN member "geographic entity" and is not a UN member. Nor is it possible for us to make any inquiries directly with the United Nations. We have searched the website of the ICRC in Geneva [login to view URL] but were unable to locate any relevant explanations or procedures. We are hoping someone would be able to determine how to make such an application (i.e. determination of the relevant international agency and clarification of the application procedure, costs, etc. ) for determination of Taiwan's status as "territory under military occupation." If the ICRC is not the proper agency for obtaining such a determination, then what international agency, or research organization, or think-tank, or educational institution is???
